Pune's Burger King Wins Battle Against US-fast food chain
The Supreme Court has stayed the Bombay High Court's order restraining the old Burger King from its original name, allowing the local eatery to continue operating under the name until the matter is decided.
The legal battle between the two famous eateries- Burger King (Pune's old restaurant) and Burger King Corporation (US fast food franchise) dates back to 2014 when the latter entered the Indian market for the first time. However, a Pune court ruled in the former's favour in July 2024.
The legal battle began when US-fast food giant Burger King Corporation, which entered India in 2014, sued the Pune restaurant, claiming trademark infringement. The Pune eatery, operating since 1992, argued it had prior rights. A Pune court ruled in its favor in July 2024, dismissing Burger King's suit.
However, the Bombay High Court later stayed this ruling. The Supreme Court's decision provides temporary relief to the Pune restaurant, emphasizing that an interim stay could unfairly impact a small business against a global corporation.
